Terms & Services
Effective date: October 1, 2026
These Terms & Services ("Terms") govern your access to the website located at sistemaceha.com (the "Site") operated by Sistema Ceha Insurance ("Sistema Ceha," "we," "us," or "our") and your use of informational tools, forms, and downloadable content made available through the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Nature of Our Services
Sistema Ceha is an insurance agency and brokerage that markets, solicits, and services insurance products underwritten by independent third-party carriers. We are not an insurer unless explicitly stated in a separate written agreement. Coverage is subject to the terms, conditions, exclusions, and limitations of the issuing carrier's policy forms, which control in the event of any conflict with marketing materials on the Site.
Information on the Site is general in nature and does not constitute legal, tax, or financial advice. Premium illustrations, coverage examples, and pricing tiers displayed online are estimates only and are not offers to insure. A binding agreement arises only after application approval, payment of premium as required, and issuance of a policy by the carrier.
2. Eligibility and Account Responsibilities
You must be at least eighteen years of age and capable of forming a binding contract to submit inquiries or applications through the Site. You agree to provide accurate, current, and complete information in all forms and to update that information when material changes occur. Misrepresentation or omission may void coverage or constitute fraud under applicable insurance laws.
If we provide portal credentials or document exchange links, you are responsible for safeguarding login credentials and notifying us promptly of unauthorized access. We may suspend access when we detect suspicious activity or when maintenance is required.
3. Electronic Communications and E-Signatures
By submitting forms on the Site or opting into electronic delivery, you consent to receive communications electronically, including policy documents, notices of cancellation or nonrenewal, claim correspondence, and marketing messages where permitted. You may withdraw marketing consent through the unsubscribe page linked in our footer without affecting transactional notices necessary to service active policies.
Where permitted by law, electronic signatures and click-through acceptances have the same force as handwritten signatures for applications and endorsements routed through approved platforms.
4. Quotes, Underwriting, and Placement
Quote requests submitted through the Site are routed to licensed producers who contact you to complete underwriting questions. Carriers may require inspections, medical examinations, motor vehicle reports, credit-based insurance scores where allowed, and other evidence of insurability. We do not guarantee that any carrier will offer coverage or that quoted premiums will remain unchanged at issuance.
You authorize us and appointed carriers to obtain consumer reports and supplemental reports for underwriting and claims purposes, consistent with the Fair Credit Reporting Act and analogous state statutes. You may request disclosure of reporting agencies used in connection with adverse actions when applicable.
5. Fees and Compensation
We typically receive commissions from carriers based on premiums written, and in some cases service fees disclosed in advance for specialty placements. You will not be charged advisory fees unless expressly agreed in writing. Any administrative fees associated with installment billing are disclosed in premium finance or carrier billing statements.
6. Claims Handling
Claims are adjusted and paid by issuing carriers according to policy terms. Our role includes assisting with first notice of loss, documentation checklists, and status follow-up, but we do not independently adjudicate coverage determinations. Statutes of limitation and contractual notice requirements apply; late reporting may jeopardize recovery.
7. Intellectual Property
The Site, including text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is owned by Sistema Ceha or its licensors and protected by copyright, trademark, and other intellectual property laws. You may view and print pages for personal, non-commercial use provided you do not remove proprietary notices. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit Site content for commercial purposes without prior written consent.
"Sistema Ceha Insurance" and associated logos are trademarks of Sistema Ceha. Other names and marks appearing on the Site belong to their respective owners and are used for identification only.
8. Acceptable Use
You agree not to misuse the Site, including by attempting unauthorized access to systems, introducing malware, scraping content in bulk, impersonating another person, submitting false claims information, or using automated tools that degrade performance. We may cooperate with law enforcement regarding fraudulent submissions or cyber incidents.
9. Third-Party Links and Tools
The Site may link to carrier portals, payment processors, or educational resources operated by third parties. We do not control and are not responsible for third-party content, privacy practices, or availability. Your use of third-party services is subject to their terms.
10. Disclaimers
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Coverage descriptions on the Site simplify complex policy language. Always read the policy jacket, declarations, endorsements, and exclusions issued by the carrier before relying on coverage.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SISTEMA CEHA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SITE OR RELIANCE ON SITE CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS (US $100) OR THE AMOUNT YOU PAID US FOR SERVICES IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER, EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE INSURANCE REGULATIONS GOVERNING PRODUCER CONDUCT.
12. Indemnification
You agree to indemnify and hold harmless Sistema Ceha from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, misuse of the Site, or inaccurate information provided in applications or claims submissions.
13. Privacy
Our collection and use of personal information is described in the Privacy Policy, incorporated into these Terms by reference. By using the Site, you acknowledge that you have read the Privacy Policy.
14. Modifications
We may update these Terms to reflect changes in law, carrier requirements, or Site functionality. Material changes will be indicated by updating the effective date above. Continued use after changes constitutes acceptance. For active policies, carrier-issued contracts govern over Site Terms where they conflict.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the state in which Sistema Ceha maintains its principal agency license, without regard to conflict-of-law rules, except that consumer protection mandates of your state of residence may apply where required. Before initiating formal proceedings, you agree to contact us to attempt informal resolution. If unresolved, disputes shall be brought in the state or federal courts located in that principal licensing state, and you consent to personal jurisdiction there, unless mandatory arbitration clauses in separate service agreements apply to specific products.
16. Severability and Waiver
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. Failure to enforce a provision is not a waiver of future enforcement.
17. Licensing and Regulatory Notices
Insurance is heavily regulated. Producers acting on your behalf must hold active licenses in the states where products are sold. Policy forms, rates, and advertising materials are filed with departments of insurance and may change without prior notice on the Site. If a discrepancy arises between a carrier filing and a summary on the Site, the filed version controls.
You may request producer license numbers and carrier financial strength ratings before binding coverage. We provide this information upon request through our contact channels.
18. Cancellation and Nonrenewal
Policy cancellation, nonrenewal, and refund rules are governed by carrier contracts and state statutes, not by these Site Terms. When you authorize us to process a cancellation, we transmit your request to the carrier and confirm effective dates in writing. Premium refunds, if any, are calculated by the carrier according to short-rate or pro-rata provisions in the policy.
19. Force Majeure
We are not liable for delays or failures resulting from events beyond reasonable control, including natural catastrophes, widespread communication outages, labor disputes, or governmental actions, except where insurance regulations require continued servicing of in-force policies.
20. Contact
Questions about these Terms may be submitted through the Contact Us form on this Site. We respond to legal and compliance inquiries during regular business hours.
